Llama mucho la atención la cantidad de vacios y dudas que deja la incautación de WAMU. Pienso que cada vez hay mas indicios de que definitivamente NO se manejo de buena fe la incautación DE WAMU y tampoco la posterior negociación ( cuyo objetivo de Rosen y su grupo es la aprobación de UN POR ´que por el momento no cumple con todos los requisitos) Espero que con la actuación del EC y de algunos accionistas que han presentado recursos ante la corte , se pueda destapar estos actos dudosos por decir lo menos ; y de esta forma llegar a la verdad de este caso.

This motion is very concise, well-written, on point, and compelling. (Good work, Ashby Geddes and Susman Godfrey.) As ya'll may recall, I was very distressed, depressed, disappointed and amazed that Judge W took it upon herself to be the ultimate "expert" in this case, relieving the debtor of it's affirmative obligation to actually present competent, credible (LOL!) and admissible evidence in support of it's burden of proof that the POR (and the GSA) was "fair and reasonable". That may be how Judge Judy handles a Small Claims Court case on TV, but where thousands of people and tens of billions of dollars are involved in the largest bank bankruptcy in history? No way. Big mistake, IMHO. She was too focused on final resolution rather than quality control and due process. This motion to certify calls her on that, and persuasively demonstrates that she should certify the matter for direct appeal to the 3rd Circuit Court of Appeal because the circumstances satisfy all four possible grounds for certification. It is her duty to acknowledge that fact (on at least one of the four possible grounds) in order to expedite resolution of novel issues central to the ultimate resolution of the case. I'm sure she will, even if/though she thinks she made the correct decision. A bonus to granting certification: It puts more pressure on all the parties to work toward settlement, which I believe is her ultimate goal. P.S. I've been in a similar position on many occasions over the years, and have almost always certified the issue on appeal, except where there was a technical deficiency in the request. That doesn't exist here, except arguably on the issue of "finality" of her decision. In my opinion, even if this could be construed as an "interlocutory decree", it is so central to the ultimate outcome of the case it is/should be still immediately worthy of appeal

Maxi ahora por fin entiendo tu punto de vista 1 jpm /fdci/ jamás perjudicaron a wamu 2) Bopfan es un pumpeador y conjuntamente con otros lograron hacernos creer (inclusive a la juez )del supuesto perjucio en la negociación de wamu. Si nos hubieras explicado (que todo esto era una farza y que no había perjucio para los accionista) , desde el momento que empezaste a participar en el foro,a lo mejor muchas personas no hubiésemos invertido en wamu te aseguro que mucha gente no habría invertido en estas acciones 3) grAcias a la capacidad de ellos : lograron que se cree el ec el examinador que puedan participar en las audiencias 4) pero todo esto es una farza ,ya que la negociación de wamu estuvo bien realizada,Y los accionistas no tienen nada que reclamar

ESTIMADOS : LA PREGUNTA SIN RESPUESTA QUIEN TIENE LA RAZON: FEDOREME O SIMPSON ROSEEN O SUSMAN JPM/FDI/ O EC SEÑORES a esto se reduce todo: Tanto FEDOREME como SIMPSON lo único que hacen es defender una postura el primero de ( JPM/FDI/ROSEN) y el segundo del (EC / SUSMAN) Y al defender cada postura lo que hacen es apoyarse; informarse y trasmitir al foro los sustentos que los 2 GRUPOS mencionados tienen. Esto para mí es tan sencillo como: Los FORISTAS que apoyan al grupo ( JPM/FDIC/ROSSEN/FEDOREME)piensan que su postura es la verdadera. Mientras que los foristas que apoyan al grupo( EC/SUSMAN/SIMPSON) también piensan que su postura es la correcta.

ESTIMADO FEDOREME: Es importante aclarar que aquí en este foro hay dos posiciones: LA TUYA que piensaS que la negociación entre la FDIC y JPM para adquirir WAMU fue transparente, clara, pagando los valores justos; etc Y por eso estas corto y apostando a la baja. Y la otra ( en la que están incluidos la mayoría de los foristas) que consideran que existió errores, equivocaciones , negligencia en la forma que actuaron con WAMU y por consiguiente se perjudicó al banco como tal ; a sus empleados, deudores y accionistas. Y por esta razón creen que existe posibilidades reales de redimir en algo los errores cometidos, y por ende están apostando a que las acciones subirían PERO ESO NO SIGNIFICA QUE LOS QUE TIENEN UNA POSTURA DIFERENTE A LA TUYA ( TU LES LLAMES LADRONES E INGENUOS)
